Washington Consumer Health Data Privacy Policy

The short version. PlainWay is a navigation app. It is not a health app, and we do not set out to collect health information about anyone. But Washington law treats some location data as health data, because where you drive can reveal where you sought care. This page explains what that means here — which is, in practice, very little, because we do not keep your location at all.

This policy is published separately because Washington's My Health My Data Act (RCW 19.373) requires it to be. It sits alongside our general Privacy Policy. Nevada has its own, narrower law and its own page: Nevada Consumer Health Data Privacy Policy.

2. What "consumer health data" means here

Washington's definition includes "precise location information that could reasonably indicate a consumer's attempt to acquire or receive health services." PlainWay never asks you about your health, and it has no idea what any destination means to you. But if you search for or route to a clinic, a hospital or a pharmacy, then for the moment it takes to answer that request, what you typed, your position and your destination are handled by our server. Under Washington law that can be consumer health data, so we treat it as such.

That is the only category that can arise, and its only source is you, through the app. We collect no symptoms, no diagnoses, no medications, no biometric or genetic data, no reproductive or gender-affirming care information, and nothing from any health provider, insurer or wearable device.

We do not sell consumer health data. We have never sold it, and we will not. Selling it would require your valid authorisation under RCW 19.373.070, and we have no intention of ever asking for one.

These service providers handle parts of a request in the moment it is made, because that is how a place gets found and a route gets drawn:

None of them is told who you are, because we do not know: PlainWay has no accounts and no sign-in.

5. Your rights

As a Washington consumer you have the right to confirm whether we are collecting, sharing or selling your consumer health data, to see it, to obtain a list of everyone it has been shared with, to withdraw consent, and to have it deleted. Write to support@plainway.app. We will answer within 45 days, extendable once by a further 45 days where the law allows and we tell you why.

The honest answer to most such requests will be that we hold nothing about you. There is no account to look up, and a request that has been answered leaves nothing behind. If you ask us to delete data and we are holding none, we will tell you so plainly rather than pretend to have performed a deletion.

Appeals. If we decline your request, you can appeal by replying to our decision with "Appeal" in the subject line. We will answer the appeal in writing within 45 days. If we deny it, you may complain to the Washington State Attorney General at atg.wa.gov/file-complaint.

6. Changes

If this policy changes we will update the date at the top. Material changes will be brought to your attention in the app, and we will not apply a change retroactively to data collected under an earlier version.
